Whatever you pay to the exchequer is paid in the beginning only. You pay land tax-a pittance. You keep property for 50 years. It is potential wealth, cash stashed. 80% of the landed property is held by less than 10% of the citizenry. 90% of the people are deprived of holding property. There is no law in India to tax the accumulated property and held by individuals. Suppose the stamp duty you pay for purchasing a property is collected as yearly tax on the wealth created there would be a movement perceptible. With a small research a big area can be unearthed. Collection of I-T will be relegated to the background.

Supreme Court of India is criticized, a lot, these days. It has unfortunately originated from its own domain. Media takes it up; and sensationalize. It is universally admitted that the Court is supreme, but not infallible. As a peoples’ institution the Court keeps its doors wide open . Even a letter addressed to a Judge or to the Court in general is judicially acted upon, if it deserves to be acted upon. A news item in the media impacting public interest get judicial response from the court suo motu. Still, the Court is criticized, devastatingly; and without empirical verification. Words can hurt when one “speak daggers”unmindful of yesterdays and tomorrows.It is with a hurt feelings these words are penned because the Supreme Court of India is maliciously criticized these days ;indiscreetly, by those obliged to guard its honour. But the Court founded and working on high jurisprudential bases , structured on the principle of Constitutional morality and Ideals connecting justice with the sociology of law shall not be cowed down by unfounded allegations

Supreme Court of India has played a pioneering role to inspire and enthuse the lawyers and litigants to avail the alternate
remedies. Mediation, among them, has got institutionalised, today. Recently, senior judge of the Supreme Court Mr.Justice L.Nageswara Rao in a dialogue with the President of the Commonwealth Lawyers’ Association, Mr.Brian Speers underscored the credibility and viability of Mediation . Mr. Speers and Advocate Mr. Santanakrishnan of the Supreme Court, erstwhile president of CLA, are on a proselytising mode advocating Mediation.

The history of the Enforcement of Foreign Awards paved way to various enactment of special Act such as The Foreign Awards ( Recognition and Enforcement) Act-1961 to recent landmark judgments like Vijay Karia & Ors Vs Prysman Cavi Sisterni SRL & Ors . Since it is being the complex issue , the Hon’ble Courts has to go through a hair spit check of morality, justice and Public Policy while Enforcing a Foriengn Arbitration Award in India.
The basic purpose of arbitration is to bring about cost-effective and expeditious resolution of disputes and further preventing multiplicity of litigation by giving finality to an arbitral award. The article ambidextrously and comprehensively analyzes India’s Commitment and challenge to the International Arbitration in the era of globalization when the investment by the foreign entities is at the peak.
Public Policy of India has most important role in the whole process of enforcement of an arbitral awards particularly the foreign awards because it involves parties, lawyers and arbitrators form diverse legal &cultural traditions. Most often the arbitral tribunal consists of arbitrators from multiple jurisdictions & legal traditions different from those of parties and of their council.
BLUE ECONOMY

The concept was introduced by Gunter Pauli in his 2010 book- “The Blue Economy: 10 years, 100 innovations, 100 million jobs “It is the sustainable use of ocean resources for economic growth, improved livelihoods and jobs, and ocean ecosystem health.It advocates the greening of ocean development strategies for higher productivity and conservation of ocean's health.
It encompasses–
Renewable Energy: Sustainable marine energy can play a vital role in social and economic development.
Fisheries: Sustainable fisheries can generate more revenue, more fish and help restore fish stocks.
Maritime Transport: Over 80% of international goods traded are transported by sea.
Tourism: Ocean and coastal tourism can bring jobs and economic growth.
Climate Change: Oceans are an important carbon sink (blue carbon) and help mitigate climate change.
Waste Management: Better waste management on land can help oceans recover.
Blue Economy emphasizes on integration of development of ocean economy with social inclusion, environmental sustainability, combined with innovative business model. This is reflected in Sustainable Development Goal (SDG 14), which calls to conserve and sustainably use the oceans, seas and marine resources for sustainable development.
Need for Blue Economy
1) Oceans cover three-quarters of the Earth’s surface, contain 97% of the Earth’s water, and represent 99% of the living area on the planet.
2) Oceans protect biodiversity, keep the planet cool, and absorb about 30% of global Omissions of carbon.
3) At least 3-5% of global GDP is derived from oceans.
4) Blue economy, through sustainable use of oceans, has great potential for boosting the economic growth by providing opportunities for income generation and jobs etc.
Challenges
Threat of sea borne terror – piracy and armed robbery, maritime terrorism, illicit trade in crude oil, arms, drug and human trafficking and smuggling of contraband etc.
Natural Disasters – every year tsunamis, cyclones, hurricanes typhoons etc leave thousands of people stranded and property worth millions destroyed.
Man-Made problems – Oil spills, climate change continue to risk the stability of the maritime domain.
Impact of climate change – changes in sea temperature, acidity, threaten marine life, habitats, and the communities that depend on them. Marine pollution – in form of excess nutrients from untreated sewerage, agricultural runoff, and marine debris such as plastics
Overexploitation of marine resources – illegal, unreported, and unregulated extraction of marine resources. The first global conference on the Sustainable Blue Economy was held on 26-28 November, 2018 in Nairobi Kenya. Seychelles recently launched the sovereign Blue Bonds.
Blue Bond
Seychelles became the first country in the world to launch sovereign Blue Bonds.
It is a debt instrument issued by governments, development banks etc to raise capital from investors to finance marine and ocean-based projects.
It will help in expansion of marine protected areas, improved governance of priority fisheries and the development of the Seychelles’ blue economy.
The blue bond is inspired by the green bond concept.
Blue Economy for India
Blue economy presents India with an unprecedented opportunity to meet its national socio-economic objectives as well as strengthen connectivity with neighbors.
Blue Economy can help in focusing on livelihood generation, achieving energy security, building ecological resilience, and improving health and living standards of coastal communities.
Blue economy would reinforce and strengthen the efforts of the Indian government as it strives to achieve the SDGs of hunger and poverty eradication along with sustainable use of marine resources by 2030.
India has a long coastline of 7,517 km covering nine states and two union territories – with an Exclusive Economic Zone (EEZ) of 2.02 mn. sq.km.
Marine services sector could serve as the backbone of its blue economy and help India become 10 trillion dollar economy by 2022.
Indian Ocean is a major conduit of trade with as much as 80% of global oil trade happening through it.
Better connectivity in the region will significantly cut the transport cost and maritime wastage of resources making the trade sustainable and cost effective.
Developments Initiated by India
The Sagarmala project is the strategic initiative for port-led development through the extensive use of IT enabled services for modernization of ports.
Sagarmala Project
Project aims at developing Inland waterways and coastal shipping which will revolutionize maritime logistics, creating million new jobs, reduce logistics costs etc.
It focuses on the development of coastal communities and people in the sustainable use of ocean resources, modern fishing techniques and coastal tourism.
India has an umbrella scheme by the name of O-SMART which aims at regulated use of oceans, marine resources for sustainable development.
Integrated Coastal Zone Management focuses on conservation of coastal and marine resources, and improving livelihood opportunities for coastal communities etc.
Development of Coastal Economic Zones (CEZ) under Sagarmala would become a microcosm of the blue economy, wherein industries and townships that depend on the sea will contribute to global trade.
India has a National Fisheries policy for promoting 'Blue Growth Initiative' which focus on sustainable utilization of fisheries wealth from the marine and other aquatic resources.
Way Forward
India should look to adopt the Gandhian approach of balancing economic benefits with sustainability for meeting the broader goals of growth, employment generation, equity and protection of environment.
India must focus on marine ICTs, and transport (shipping) and communication services, and the creation of a knowledge hub for marine research and development.
An effective response mechanism to address humanitarian crises and natural disasters should be made for the evolving Indian Ocean security strategy.
India should not look at its oceans as just water bodies, but as global stage for continued economic, social, and cultural dialogue.

Diplomacy includes strategy, tactics,use of intelligence and wisdom, planning with policy etc. Ramayan and Maha Bharat abound in use of diplomacy by all characters and situations. The lessons of diplomacy we learn from Ramayan is illustrious, instructive and informative and above all interesting. ഈ വിഷയത്തിൽ ഒരു ഒത്തു ചേരൽ CG3 യുടെ മാധ്യമത്തിൽ നടത്തുന്നതിന്റെ ആവശ്യകതയും സന്ദർഭവും വിചിന്തനീയമാണ്. പൊതു ഇടങ്ങൾ, വിശേഷിച്ചും ജനാധിപത്യ വ്യവസ്ഥിതികളിൽ, ജനങ്ങളുടെ സ്വതന്ത്രവിഹാരത്തിന് ഉള്ള ഇടങ്ങളാണ്. സാധാരണ ജനങ്ങളുടെ താൽപര്യങ്ങളെയും വിശ്വാസങ്ങളെയും പ്രവർത്തനങ്ങളെയും സ്വാധീനിക്കുകയും സംരക്ഷിക്കുകയും രൂപപ്പെടുത്തുകയും ചെയ്യുന്ന പ്രവർത്തനമാണ് പൊതു പ്രവർത്തനം. ഇത് നാനോന്മുഖമായ സ്വഭാവവിശേഷം ഉള്ളതും സാധ്യതകൾ ഉള്ളതും ആയ ഒരു പ്രവൃത്തിയും പ്രവർത്തനവുമാണ്. സാധാരണ പൗരന്മാർക്ക് ഉള്ള എല്ലാ നിയമ സംരക്ഷണവും അവകാശങ്ങളും പൊതുപ്രവർത്തകർക്കും ലഭ്യമാണ് പക്ഷെങ്കിൽ പൊതു പ്രവർത്തകരുടെ ബാധ്യതയുടെയും ചുമതലയുടെയും തോത് സാധാരണക്കാർക്ക് ഉള്ളതിലും വ്യത്യസ്ഥമാണ്, വിപുലമാണ്, വിസ്തൃതമാണ്. അവർ സമൂഹത്തിൽ മാതൃകാപരമായ മനുഷ്യത്യപരമായ മാന്യമായ മര്യാദയോടു കൂടിയ സഭ്യമായ പ്രവർത്തനം കാഴ്ചവെക്കണം.

പൊതുപ്രവർത്തനത്തില പ്രധാന മണ്ഡലങ്ങളിൽ പരക്കെ മനസിലാക്കിയിട്ടുള്ള, പ്രാബല്യത്തിലുള്ള ഒന്നാണ് രാഷ്ട്രീയ പ്രവർത്തനം ഭരണഘടന അനുസരിച്ച് നിയമ സംഹിതക്കുള്ളിൽ ആശയപരമായി സംഘടിച്ച് സംഘടനകളുടെ വാഗ്മികളായി പ്രവർത്തകരായി സമൂഹ മധ്യത്തിൽ പ്രവൃത്തിക്കേണ്ടുന്നവരാണ്, അവരുടെ വാച്യവും പ്രവൃത്തിയും ശരീര ഭാഷയും ഇത്തരുണത്തിൽ അർത്ഥവത്താണ്,വളരെയധികം പ്രാധാന്യമർഹിക്കുന്നതുമാണ്.
ഇന്നത്തെ ഈ ഒത്തു ചേരലിൽ നാം ആഗ്രഹിക്കുന്നത് നമ്മുടെ ഇടയിൽ സന്നിഹിതരായ മഹത് വ്യക്തികൾ അവരുടെ അനുഭവത്തിൽ കൂടിയും അവരുടെ വിശ്വാസത്തിൽ കൂടിയും അവരുടെ വിചാരധാരയിൽ കൂടിയും സഭ്യത, മാന്യത, മര്യാദ എന്നീ ഗുണവിശേഷങ്ങളെക്കുറിച്ച് സാക്ഷ്യപ്പെടുത്തുന്നത് കേൾക്കുവാൻ ശ്രോതാക്കൾ കാതോർത്ത് ഇരിക്കുന്നു.
പൊതുപ്രവർത്തകർ എന്നാൽ രാഷ്ട്രീയ പ്രവർത്തകർ മാത്രം എന്നർഥമില്ല. അഭിഭാഷകരും മാധ്യമപ്രവർത്തകരും മനുഷ്യാവകാശ പ്രവർത്തകരും മറ്റു പല ശ്രേണികളിലും രംഗങ്ങളിലും പ്രവർത്തിക്കുന്നവരും പൊതുപ്രവർത്തകരാണ്. എങ്കിലും ജനങ്ങളോട് കൂടുതൽ അടുത്ത് നിൽക്കുന്നവർ അടുത്ത് പ്രവൃത്തിക്കുന്നവർ അടുത്ത് ഇടപഴകുന്നവർ രാഷ്ട്രീയ പ്രവർത്തകരാണ്.
പൊതുപ്രവർത്തനത്തിന്റെ കാതും കരളും പൊരുളും രാഷ്ട്രീയ പ്രവർത്തകരുടെ സ്വഭാവത്തിലും പെരുമാറ്റത്തിലും പ്രവർത്തനത്തിലും നിക്ഷിപ്തമാണ്. ഈ വിഷയം ചർച്ച ചെയ്ത് അവസാനിപ്പിക്കേണ്ട ഒന്നല്ല അത്, ഈ മൂല്യങ്ങൾ നിത്യ ജീവിതവും നിസ്തുലമായ സേവനത്തിൽ പ്രാവർത്തികമാക്കേണ്ടതാണ്.
പക്ഷെങ്കിൽ അറിവും അനുഭവവും അഭിവാഞ്ചയും ഉള്ള പ്രവർത്തകരുമായി സംവദിക്കുമ്പോൾ നമുക്ക് മുന്നോട്ട് പോകുവാൻ ഉള്ള ദിശ കൂടുതൽ സരളമായി സ്വഛന്ദമായി തുറന്ന് കിട്ടും എന്നുള്ള വിശ്വാസത്തോടെ നമുക്ക് കേൾക്കാം ശ്രദ്ധയോടെ സുമസുകളായ നമ്മുടെ വിശിഷ്ട വ്യക്തിത്വങ്ങളെ .

A PROTAGONIST EXCEPTIONALLY EXCELLENT
Dr. N. Narayanan Nair was born in a wealthy family in 1927 at Koliyakode, a rural village near Venjaramoodu in Thiruvananthapuram District. He completed the Intermediate Course from the University College, Thiruvananthapuram and also did B.Sc. in Pure Mathematics from the same college. Thereafter, he joined the Government Law College, Ernakulam and passed LL.B. in the year 1953 and enrolled as Advocate in the year 1954. He started his legal practice as Junior to Late Advocate Krishnaswamy Iyyangar (who is the father of Justice Paripoornan). Dr. Narayanan Nair completed his LL. M. in the year 1955 with first rank from the Kerala University and he obtained his Ph.D. in Law from the Kerala University in 1968 which was the first Ph. D. in law awarded by the Kerala University.
He was an active member of the undivided Communist Party holding position of District Executive Committee member of Trivandrum District of the undivided Communist Party and continued with CPI after the split and was member of the State Council of CPI for a long period. He also served as a lecturer at the Government Law College, Trivandrum. During this period he had worked as Election Committee Secretary in the Legislative Assembly election in one of the legislative assemblies in Kerala. For this reason he was terminated from service from the Government Law College, Trivandrum which was within one year of his appointment. He challenged his termination before the High Court of Kerala and the High Court decided in his favour by striking down his termination. But he did not rejoin the Law College as Lecturer and the rest is history of legal education in Kerala and the birth of one of the novel institutions in the field of legal education, the Kerala Law Academy.
The Kerala Law Academy was formed in 1966 by Dr. Narayanan Nair along with Justice V. R. Krishna Iyer, Justice Subramanian Potti, former Education Minister K. Chandrasekharan, Senior Advocate S Narayanan Potti, Advocate Kalathil Velayudhan Nair, Senior Advocate S Eswara Iyer, Former Advocate General M M Abdul Khader, Justice Sivaraman Nair and others. Kerala Law Academy Law College was started in the year 1967 and Dr. Narayanan Nair was the Founder Secretary of Kerala Law Academy. Later, Kerala Law Academy started a research Centre at Punnen Road, Trivandrum, near Government Secretariat, in the year 1974 and the said research institute had produced several PhDs.
Earlier Dr Nair Narayanan Nair had worked as the Secretary of All India Peace and Solidarity Organization and leader of India - Soviet Cultural Society and in those positions, he had visited Soviet Union twice and Stockholm in Sweden and several other East Europian countries. He also visited Birmingham in United Kingdom to attend the International Conference on Legal History as a prominent invited Speaker in the Conference.
Dr. Narayanan Nair was elected to the Kerala University Syndicate 5 times and was a member of the Kerala University Syndicate for a period of nearly 24 years, which is the longest period a person is holding the post of member of the Syndicate of the University of Kerala. He has also been member of the Senate of the University of Kerala since 1963, viz. he has been a Senate Member of the Kerala University continuously without a break for nearly 50 years, which is a record period for a person occupying that position in any university in India.
He has been a member of the Faculty, Academic Council and Board of Studies of several Universities and has been a question paper setter for the Union Public Service Commission Examinations and valuer/examiner for grant of PhD in law in several Universities. He was also member of selection Committee for selection of the Vice Chancellor of Universities on five occasions (for selection of Vice Chancellor of Kerala University on two occasions and of NUALS on three occasions).
He was a member of the Bar Council of Kerala continuously since 1990 till 2016 and has been instrumental in transforming the Council to its present shape and has served as the Chairman of the Executive Committee of the Bar Council of Kerala for more than 15 years. Shri Narayanan Nair, as Managing Trustee of Bar Council of Kerala Trust took the lead role in creating NIALS (National Institute of Advanced Legal Studies, Kochi), established by the Bar Council of Kerala Trust in 2002 and played a pivotal role in transforming NIALS into NUALS (National University of Advanced Legal Studies, Kochi), the premier National Law University in Kochi in 2005. He also served as Vice-Chancellor of NUALS from 01.06.2007 to 31.12.2008 (19 months) during which period he signed the first degree certificates issued by NUALS. He played the crucial role in planning and developing the present day campus and buildings of NUALS and he continued as Member of Executive Committee of NUALS right from the formation of NUALS till his death.
Dr. Shri N Narayanan Nair is survived by his three children, Raj Narayanan, Lakshmi Nair (cookery expert and former Principal, KLA and presently Research Director, CALSAR), and Nagaraj Narayanan (Advocate, Kerala High Court and member, Bar Council of Kerala). His wife, Ponnamma, a former Indian Audit and Accounts Service official, who retired as Deputy Account Genera, AG’s Office and Finance Officer and Chief Accounts Officer, KSRTC, had predeceased him.

Dr. V. L. Mony, Professor and Dean , Hindustan Institute of Technology and Science and Patron to CG3 will be remembered for his outstanding academic contribution and sterling personal qualities. Dr. Moni is a post graduate in Commerce from Kerala University , who subsequently pursued law as his carrier. He did his LLB from Kerala Law Academy Law College and obtained post graduation in Business Laws ( MBL) as well as LL.M. in International Laws from Kerala University . He pursued Ph.D from Berhampur University , Odisha in Human Rights Law in the year 2006 and also obtained LL.D from the same University in 2013 on enforcement of Intellectual property rights in India.
Dr Mony had a formidable intellect and a keenly curious mind that brooked no silos. It easily transported itself across contexts — whether it was human rights issues intellectual property violations, works in social sectors such as health and education or working with government on policy.
Mony sir, as he was warmly referred to in his circles, was a kind soul with an incredible work ethic. His passionate approach to the field of law earned him numerous accolades. He was a giant in the field of legal education. He spearheaded numerous institutions working in various capacities, some of which include Executive Director of VIPS, Professor and Associate Dean, Sela Qui College of Law, Dehradun, Sr.Associate Professor, University of Petroleum and Energy Studies, Executive Director, Vivekananda Institute of Professional Studies and Principal, Kerala Law Academy Law College which was his alma matter.
Dr.Mony, who was an industrious personality was not one to take breaks from his work but was one who took pleasure in his work. He was always immersed in one project or other. As a result of which he authored numerous books including Handbook on Company Law and Private international Law (conflicts of laws), Central Law publication and Notes on law of evidence 1st Edition, Asia Law House. He was not in the habit of saying no and was always supportive of new endeavors and adventures. His relation with CG3 was profound and positive. He was one of the patrons of CG3 and was an immense supporter of CG3’s objectives. He was instrumental to the conduct of numerous seminars and projects organised by CG3. His absence is deeply felt. The Covid – 19 pandemic takes a heavy toll on us all by wresting Dr. V L Mony from us.
Dr. Mony will definitely live through his works, in his students’ memories and through the many present day academics that he has taught, guided and mentored.
